Anyone still living can buy a life insurance policy. However, I have never gotten the deathrow question and am anxious to find out the answer.
I think if the insured is incarcerated, they may not cover him period. But if he is otherwise only terminal, he would qualify for a no questions asked or graded benefit policy.

: Are the terminally ill eligible for life insurance if they do not already have it? Can the spouse of a death row inmate buy a policy for him/her? If I loan money to friends, thereby establishing a financial interest, can I buy life insurance policies for them, making myself the beneficiary? With regard to the previous question, are there any legal guidelines to what loan amount would constitute a "financial interest"?
